Florida has a tiered penalty system of drugged driving laws.

First Offence

The first offense of drugged driving will result in a fine up to $1000, up to six months in jail, license suspension for up to 1 year, 50 hours of community service, and 10 day vehicle impoundment.

Second Offence

The second offense will result in a fine up to $2000, jail up to 9 months, a mandatory ignition interlock system, license suspension up to 1 year, one year of probation, fifty hours of community service, and a 10 day vehicle impoundment.

Third Offence

The third offence for drugged driving can lead to a fine up to $5000, jail up to one year, a mandatory ignition interlock system, one year of probation, fifty hours of community service, and a 10 day vehicle impoundment.

Third Offence within 10 Years of the Second

Third offence within a decade of being convicted of the second offence can result in a felony charge with a maximum jail sentence of five years in addition to the regular penalties of the third offence.

Fourth Offence

The fourth offence is a third degree penalty in addition to the regular penalties of the third offence.

Other Penalties

Additionally, drug driving laws penalties might be assessed if the drugged driving resulted in bodily injury or property damage.
